WebWorks Technologies terms of service: plans and billing, domains and email, cancellation, refunds, liability, and governing law.
By accessing or using WebWorks Digital Technologies' website, services, or subscribing to any plan (collectively, the "Services"), you represent that you are of legal age to form a binding contract in your jurisdiction and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you ("Client") and WebWorks Digital Technologies ("we," "our," or "us").
WebWorks Digital Technologies provides custom website design, development, managed web hosting, business email account provisioning, domain registration, SSL certificate management, and unlimited content modification services as described in your selected plan. Services are delivered via our web platform and rely on third-party infrastructure providers, including Amazon Web Services (AWS), for hosting and content delivery.
3.1 Plans. We offer subscription-based service plans, each consisting of a one-time setup fee and a recurring monthly fee. Details of current plans, including pricing and included features, are available on our Pricing page.\n\n3.2 Setup Fee. The one-time setup fee is due upon agreement to commence services and covers design, development, and launch of your website. This fee is non-refundable once design work has begun.\n\n3.3 Monthly Subscription. The recurring monthly fee covers managed hosting, SSL, backups, monitoring, maintenance, and unlimited content modifications. Monthly billing begins on the day your website is launched live and is charged automatically each month to the payment method you save at checkout.\n\n3.4 Payment. All fees are charged in CAD. We use Stripe as our payment processor. By providing payment information, you authorize us to charge your payment method for all applicable fees. You are responsible for keeping your payment information current.\n\n3.5 Price Changes. We reserve the right to modify our pricing with 30 days' advance notice by email. Continued use of the Services after the effective date constitutes acceptance of the updated pricing.
4.1 Domain Inclusion. Each plan includes a domain name up to a specified value (see current plan details). If your desired domain exceeds the included value, you are responsible for the difference. Domain registration is subject to availability and the terms of the relevant registrar.\n\n4.2 Domain Ownership. All domains registered on your behalf are owned by you and may be transferred to you at any time upon written request.\n\n4.3 Business Email. Each plan includes a set number of free business email accounts (see current plan details for the exact count per plan). Additional email accounts may be available at additional cost. Email services are provided through third-party providers and are subject to their respective terms.
5.1 Included Modifications. Unlimited content modifications are included in all plans. "Content modifications" means updates to text, images, product listings, pricing, and other website content. This does not include full redesigns, structural changes, or adding pages beyond your plan's page limit, which may require a new scope agreement and additional fees. We reserve the right to decline modifications that violate these Terms, applicable law, or third-party rights.\n\n5.2 Your Content and Instructions. You are responsible for the accuracy, completeness, and lawfulness of all content you provide to us and of every change you ask us to make, including prices, hours, offers, descriptions, and images. We act on your instructions as given and do not verify them. You confirm that you hold the rights to use any material you supply. We are not liable for any loss arising from content or changes you supplied, requested, or approved, including reliance on that content by your customers. If you spot an error, tell us and we will correct it as a content modification at no extra charge.\n\n5.3 Fair Use of Modifications. "Unlimited content modifications" are intended to support standard, human-directed business operations. We reserve the right to throttle, delay, or require a separate scope agreement for modification requests that are submitted at an abusive volume, generated programmatically, or directed by automated systems or AI agents in a manner that exceeds typical operational capacity.
6.1 Cancellation. You may cancel your monthly subscription at any time by sending written notice of cancellation to info@webworkstechnologies.com. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.\n\n6.2 Setup Fee. The one-time setup fee is non-refundable once design work has commenced. If a project is cancelled before design work begins, a full refund of the setup fee will be issued.\n\n6.3 Post-Cancellation. Upon cancellation, your website will remain live until the end of the current billing period. Thereafter, hosting will cease. We will provide a 14-day window for you to migrate your content or request a data export.\n\n6.4 Downtime. While we rely on robust third-party infrastructure to maximize uptime, scheduled maintenance and unforeseeable outages may occasionally occur. Such downtime does not entitle you to any refunds, credits, or deductions against your monthly subscription fee.
